Dog Clothing Terms & Conditions

  1. General
    1. The use of and purchase of goods from this Site, www.dog-clothing.co.uk (‘the Site’), are governed by these Terms & Conditions.
    2. The Site is operated by us, Charlie & Ben.
    3. Please read them carefully. They do not affect your statutory rights as a consumer.
    4. We recommend you to print and keep a copy of these Terms and Conditions for future reference.
    5. By placing your order you accept and agree to be bound by these Terms and Conditions
    6. Any amendments to these Terms and Conditions are invalid unless we have agreed to them in writing.
    7. Please refer to Privacy Policy for your data protection rights and other applicable terms.
    8. Additional terms may apply for prize competitions, pre-release orders and our added value services and offers. If so, you will be alerted to them at the relevant juncture.
    9. Any other websites to which you link from the Site are governed by their own terms and conditions. We accept no responsibility nor liability for the contents or operation of those websites which are not under our control.
    10. We are required by law to tell you that sales can be concluded in English only and that no public filing requirements apply.
    11. Unless the context otherwise requires, references to the singular include the plural and references to the masculine include the feminine and neuter genders and vice versa.
    12. The headings in these Conditions are inserted for convenience only and shall not affect their construction.
  2. Order Process
    1. When you place an order to purchase items from our Site, this is an offer by you to us to purchase those items. We will confirm receipt of your order by sending you an email summarising the details of your order, an Order Confirmation E-mail.
    2. We accept your order only when we send an e-mail confirming that we have dispatched the items in your order, a Dispatch Confirmation E-mail. The contract between us is formed at that point in respect of those items mentioned in the Dispatch Confirmation E-mail.
    3. If your order contained a number of items and the Dispatch Confirmation E-mail mentions only some of them, each Dispatch Confirmation forms a separate binding contract.
  3. Prices & Payment
    1. All prices and charges on the Site are in UK pounds sterling. They include any VAT payable, but exclude delivery charges (for details please refer to Delivery and FAQ's).
    2. The total cost of your order will be the price of the products you order plus the applicable delivery charge. All these will be set out clearly in your Shopping Basket before you submit your order.
    3. Prices, offers and products are subject to availability and may change before (but not after) we accept your order. If something becomes unavailable we will offer you an alternative.
    4. We try very hard to ensure that all information on the Site is accurate. However, occasionally an error can occur. If we discover an error in the price or description of a product you have ordered, we will contact you as soon as possible. You will have the option of either reconfirming your order at the correct price or canceling it. If we are unable to contact you, we will treat your order in respect of the incorrectly priced item as cancelled.
    5. We accept payment from all major credit/debit cards. Payment is deducted when we process your order. We regret that we cannot accept cheques, or cash as payment online.
  4. Delivery
    1. Deliveries are normally made between Monday and Friday (exceptionally on a Saturday). Details of our delivery charges can be found in our Delivery and FAQ's.
    2. Where possible multiple item orders will be dispatched in the same package. However, occasionally this may not be possible or may cause delay so items may need to be dispatched separately and we cannot guarantee delivery on the same day.
    3. We make every effort to despatch items on time. However, time for delivery is always given as an indication and is not of the essence. If the items are not delivered within the time period we specify in the Confirmation Email, please email our Sales Department quoting your order reference number contained in the Confirmation Email.
    4. Delivery occurs when the items are delivered to the front door of the delivery address you specified when placing your order. You shall arrange someone to accept delivery and shall have no right to refuse delivery. For exports outside the United Kingdom, delivery also occurs when the items are retained by an authority of the importing country for custom and duty procedure. At the point when deliver occurs, all risks including loss, breakage and damage passes to you. Ownership of items purchased does not pass to you until payment is received by us in full.
  5. Export
    1. While the materials on the Site are directed at customers who access the Site from the United Kingdom (i.e. the island of Great Britain and Northern Ireland but does not include the Channel Islands or the Isle of Man), you can use the Site to order for delivery worldwide. However, we do not represent that any item referred to in the materials on the Site is appropriate for use or available in locations outside the United Kingdom. If you choose to access the Site from locations outside the United Kingdom you are responsible for compliance with local laws if and to the extent local laws apply.
    2. Items ordered for delivery outside the United Kingdom may be subject to import duties and taxes. These are levied once the items reach the specified country. You will be responsible for any such import duties and taxes. We have no control over these charges and cannot predict what they may be. Customs policies vary widely from country to country, so you should contact your local customs office for further information.
    3. Please note that for items ordered from our Site you are considered the importer and must comply with all laws and regulations of the country in which the items are to be delivered. Please note that cross-border deliveries may be subject to opening and inspection by customs authorities.
  6. Consumer’s Right of Cancellation (This provision does not apply to trade sales and exports outside the EU countries)
    1. As a consumer, you have a statutory right to cancel the contract at any time until seven working days after the day following delivery. You must however understand that this statutory right of cancellation does not apply to orders which are made to measure or cut to your requirements. This right is also subject to our following Return Procedure:
      1. The product must be in new, unused and resellable condition.
      2. You must inform us of the cancellation within the relevant time scale by emailing us at sales@dog-clothing.co.uk then we shall inform you of a return reference number and the location to where the goods should be returned.
      3. It is your responsibility to return the cancelled order with its original packing to the location as directed by us. Should this not be convenient for you, you may request us to collect the goods and we are entitled to charge for the collection service.
    2. We shall make a full refund for any goods returned under this term within a reasonable time, using the same method of payment as your purchase with a deduction of collection charges, if any.
    3. Other cancellations outside the above statutory right of cancellation are subject to (1) the above Return Procedure, (2) our acceptance and (3) a re-stocking charge of [35%] of the price.
    4. Please note that we do not normally accept cancellation of made to order supplies.
    5. Your statutory rights as a consumer shall not be affected by this Term. (For an example, if an item is proven to be faulty and you have informed us within a reasonable time, we shall accept your return and shall not charge you for re-stocking).
  7. Returns
    1. If you take delivery of a package from us and the goods are defective or damaged, we will exchange the items without extra charge to you or at our absolute discretion refund the price paid by you provided that you return the item to us within 7 days of taking delivery.
    2. If it is proven that the goods were defective or damaged, we shall reimburse any reasonable costs you incur in returning the items to us.
    3. Personalised items are non returnable unless they can be proven to be faulty.
  8. Liability
    1. You must inspect the goods as soon as practicable upon delivery.
    2. In the event of damage, faulty goods or short supply, you shall notify us in writing as soon as possible and in all cases within two days from the date of delivery of any alleged damage, fault or shortage. If you do not comply with this provision, you shall be deemed to have accepted the goods. We shall be afforded an opportunity to inspect and make good the supply. Should the alleged problem be proven, our liability shall be limited to making good the fault, replacing the goods or refunding the price at our absolute discretion. We shall be under no liability whatever to you for any consequential or indirect loss and/or expense (including loss of profit and extra labour costs) suffered by you arising out of the proven problem.
    3. Nothing in this Term shall restrict or exclude any liability for death or personal injury caused by our negligence or affect your statutory rights dealing as a consumer.
    4. We will not be responsible for any damage caused to you or your dog, related or consequence of an inappropriate usage of the products you purchase from us, nor from any loss resulting from an accident, such as, but not limited to the loss of your dog.
    5. Our liability to you under these Terms and Conditions will not exceed the total price charged for the items purchased. We would like to remind you that the products you purchase from us are sold “as is” with no other warranty than the one given by the producer.
  9. Force Majeure
    1. We shall not be liable to you for any loss or damage to you as a direct or indirect result of any of our duties and/or obligations being prevented, hindered, delayed or rendered uneconomical by acts of God, war, riot, strike, lock-out, industrial action, accident, breakdown of plant or machinery, fire, flood, drought, storm, difficulty or increased expense in obtaining materials, or other reasons beyond our reasonable control.
  10. Colours, specifications and dimensions of products
    1. We have made every effort to display the colours, specifications and dimensions of items on the Site as accurately as possible. The colours you see will depend on the resolution of your monitor. We cannot guarantee that your monitor's display of any colour will reflect accurately the exact colour of the item delivered.
    2. We may from time to time vary the dimensions, specifications and quantities of items displayed on our Site without prior notice.
    3. We also have made every effort to ensure the quality of the products displayed is respecting our quality and security standards, but we can not ensure that the products will be exempt of imperfections.
  11. Availability of Items and Substitution
    1. We accept orders for items subject to availability. If for any reason the items you ordered are no longer available, we will contact you by the contact details you supplied when placing your order and either:
      1. offer you an alternative item of equivalent quality and price if this is possible;
      2. or cancel the item from your order and give you a full refund in respect of that item.
    2. If we are unable to contact you or do not receive a response from you, we will process any remaining items on your order and refund you for the items we were unable to supply.
  12. My Account
    1. You may register with us to purchase items using the Site. If you do, you are responsible for maintaining the confidentiality of your account username and password and for preventing unauthorised access to your account.
    2. You agree to accept responsibility for all activities that occur under your account or password. Please take all necessary steps to ensure that the username and password is kept confidential and secure. Please inform us immediately if you have any reason to believe that your username and/or password has become known to anyone else, or are being, or are likely to be, used in an unauthorised manner.
    3. Please ensure the details you provide us with your registration are correct and complete and inform us immediately of any changes to those details (e.g. change of email or postal address).
    4. You can access and update your registration details using the "My Account" area of the Site.
    5. We reserve the right to refuse access to the Site, terminate accounts, remove or edit contents, or cancel orders at our discretion. If we cancel an order, it will be without charge to you.

    2. To fulfill our obligations to you under these Terms and Conditions we communicate with you by e-mail and by posting notices on the Site.   14. Alterations to the Site and Terms and Conditions
    1. We reserve the right at any time to make changes to the Site, these Terms and Conditions, Privacy Policy and such other policies as we may notify you of.
    2. You will be subject to the policies and Terms and Conditions in force at the time you use the Site or order items from the Site.
    3. Changes which we are required to make by law could apply to orders which you have already made.
    4. If any of the Terms and Conditions forming the contract between us are deemed invalid, void or unenforceable for any reason, it will be deemed severable and not affect the validity and enforceability of the remaining Terms and Conditions.
  15. Waiver
    1. If you breach these Terms and Conditions and we take no action we will still be entitled to use our rights and remedies in other situations where you are in breach.
  16. Law
    1. These Terms and Conditions and all transactions relating to the Site are governed by English law and are subject to the exclusive jurisdiction of the English courts.
